However, the ambiguity makes preparing for it more of a challenge than we\u2019d like to admit. However, there are a few things we are going to need your help with.<\/p><p>First, we\u2019ll need you to sign off on our updated TOS, that includes a new \u201cData Processing Addendum\u201d (keep reading for details). We\u2019ll also ask you to confirm our <a href=\"https:\/\/geniuslink.com\/privacy\">updated privacy policy<\/a>.<\/p><p>After some tweaks and upgrades on our side the only functionality that Geniuslink offers that will be affected by GDPR is around <a href=\"https:\/\/geniuslink.com\/blog\/retargeting-pixels\/\">retargeting pixels<\/a>. There are six different options that are laid out, however only three of them apply to your relationship with Geniuslink \u2013 Contract, Consent and Legitimate Interest. Let me break them down.<\/p><p>From the <strong>Consent<\/strong> perspective \u2013 When you sign up for Geniuslink, then opt into our terms of service, you are providing us with personal information (your name and email) and authorizing us to use it for the duration of our relationship (which, of course, you can end at any time). You want us to contact you when important things happen (for example, when your account is verified, we billed your credit card, etc.) and further, when you need support you probably prefer we greet you with your name.<\/p><p>From the <strong>Contract<\/strong> perspective \u2013 In order to uphold our obligation to you, we\u2019ll need to use your name and credit card during our monthly billing cycles, for example.<\/p><p>From the <strong>Legitimate Interest<\/strong> perspective \u2013 We believe that the onboarding and coaching messages for new signups, the monthly alerts to you about to the performance of your account, and answering your questions via our chat widgets throughout the website and dashboard easily fell under the \u201cLegitimate Interest\u201d.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-92a8c97 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"92a8c97\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-a309c0e\" data-id=\"a309c0e\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-1a4148d elementor-widget elementor-widget-heading\" data-id=\"1a4148d\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Our \u201cLegal\u201d Stance for Consumers<\/h2>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-bcac738 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"bcac738\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-577cdde\" data-id=\"577cdde\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-e38a5d5 elementor-widget elementor-widget-text-editor\" data-id=\"e38a5d5\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>But that\u2019s just one side of the story \u2014 What about Geniuslink storing personal information about the people that are actually clicking the links?<\/p><p>This was actually one of the most challenging aspects of GDPR compliance for us \u2014 how to responsibly come into compliance without putting undue burden on our clients when a core piece of the information we need to use is now considered \u201cidentifiable\u201d information.<\/p><p>Previously we\u2019d considered the IP address as \u201cPotentially Personal Information\u201d, a convenient title that allowed us to hold onto the IP address associated with our clicks indefinitely and still be eligible for \u201c<strong>Safe Harbor<\/strong>\u201d (the predecessor of \u201c<strong>Privacy Shield<\/strong>\u201d and certification for being a good internet citizens in the eyes of the EU and Switzerland). The IP address was ultimately one of the most important pieces of information we gleaned from a click as it not only allowed us to do our geo-targeting but is also super helpful in forensic reviews of click behavior to identify new bots and bad actors, as well as working with clients to diagnose both internal and external issues.<\/p><p>For better or worse, an IP address, under GDPR, is now considered \u201cidentifiable\u201d information and if we wanted to hold onto it we would first need a legal stance to do so, but also we\u2019d need to grant a number of \u201c<strong>Data Subject Rights<\/strong>\u201d to each person that clicked a link. Through a \u201c<strong>Legitimate Interest Test<\/strong>\u201d (that includes identifying a legitimate interest, then carrying out a \u201c<strong>Necessity Test<\/strong>\u201d, as well as carrying out a \u201c<strong>Balancing Test<\/strong>\u201d) we thought we had good grounds to use \u201c<strong>Legitimate Interest<\/strong>\u201d as a legal grounds to collect the data. But that was only part of the problem, our bigger concern was around honoring the \u201cData Subject Rights\u201d.<\/p><p>Again, we fundamentally believe that \u201cData Subject Rights\u201d is a huge step in the right direction but we were having a hard time figuring out how to continue in that direction without putting significant burden on you, our clients. We love our clients and didn\u2019t want to throw you under the proverbial \u201cGDPR Bus\u201d by taking the easy way out and making you solely responsible to uphold those rights. Simply put, we couldn\u2019t think of a good way, for either you or us, on how to collect the information necessary to provide people clicking on those links the \u201cData Subject Rights\u201d that they deserve.<\/p><p><strong>So, we ultimately made the hard decision to stop storing the IP address of clicks, effective immediately.<\/strong><\/p><p>\u00a0This change now means that there is no personally identifiable information that Geniuslink stores for people clicking a geni.us link. That means that no decision is necessary on which legal grounds are needed, no Data Subject Rights are necessary to protect and no issues with GDPR for those clicking a link.*<\/p><p>* \u2013 With one exception \u2014 when javascript for a <a href=\"https:\/\/geniuslink.com\/blog\/retargeting-pixels\/\">retargeting pixel is added to a link<\/a>.<\/p><p>To be perfectly clear, when someone clicks a link, an IP address is still transferred to us (that\u2019s a fundamental piece of how the internet works!) and we use that IP for a very short time period in order to do our click process, geo-targeting, and filtering of junk clicks, but that IP address isn\u2019t stored. Once that clicks\u2019 been processed the IP address is forever gone!<\/p><p>While this will make it a bit harder for us to diagnose new bot based IPs and troubleshoot issues with clients but we think it\u2019s the \u201cright\u201d thing and we\u2019ll get through it.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-9f81f24 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"9f81f24\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-48d9526\" data-id=\"48d9526\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-d89dd2c elementor-widget elementor-widget-heading\" data-id=\"d89dd2c\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Retargeting Pixels in Links<\/h2>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-0998cba elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"0998cba\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-f92b285\" data-id=\"f92b285\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-1348cd1 elementor-widget elementor-widget-text-editor\" data-id=\"1348cd1\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>One of the more powerful things you can do with the Genius Link service is including the javascript code necessary to fire a pixel or build a retargeting pool directly into a link. This means you don\u2019t have to drive people to your website in order to be able to retarget off of them. Now anyone clicking on your link can be added thus saving you a major step in the process.<\/p><p>However, it appears to be a common belief that with GDPR you must get the person\u2019s consent before setting a <a href=\"https:\/\/geniuslink.com\/blog\/retargeting-pixels\/\">pixel or adding them to a retargeting pool<\/a>. It seems to be pretty explicit that \u201cLegitimate Interest\u201d won\u2019t fly in this situation as a legal grounds for collecting data.<\/p><p>This creates a bit of a challenge as the links with retargeting and pixelign functionality are often used from social media and email where getting and logging consent simply isn\u2019t possible. But deprecating this feature from our links wasn\u2019t an option, it\u2019s one of the most used features by our power users!<\/p><p>So, we took the middle ground on this one. We added geo-targeting to this feature in order to turn on and off the functionality. <strong>This means that when someone clicks on a link, that includes retargeting, from inside Europe, we won\u2019t actually fire the javascript but rather continue on with the redirect<\/strong>. If the same link is clicked outside Europe the functionality is the same as before \u2013 the link will pause for a fraction of a second to run the javascript necessary to fire the pixel, then continue on to the appropriate destination.<\/p><p>By default, starting on May 25th, all links that include pixels will include this functionality. You can, however, override this behavior and make sure your links always fire the pixels, regardless of the location of the click by opting into this via the dashboard. We now have the chance to prompt the user to provide consent with regards to allowing consumers to choose if they are okay with retargeting or pixels to fire while they decide on which retailer or destination they would prefer.<\/p><p>This will make <a href=\"https:\/\/geniuslink.com\/choice-pages\">Choice Pages<\/a> a great option for you, our clients, when building a retargeting pool of European based consumers is important to you<\/p><p>It\u2019s important to note that we\u2019ll not only provide the interface for consumers to make a granular decision about pixels but we\u2019ll also be logging these to ensure we are GDPR compliant and should a consumer wish to exercise their \u201cData Subject Rights\u201d we\u2019ll have the opportunity to comply in full.<\/p><p>Please note that this functionality will likely not be available until June 2018. This often boils down to who is the \u201c<strong>Controller<\/strong>\u201d and who is the \u201c<strong>Processor.<\/strong>\u201d<\/p><p>A <strong>Controller<\/strong> is an entity that decides the purpose and manner (or \u201cmeans\u201d) that personal data is used, or will be used they also state how and why personal data is processed. Controllers are often a SaaS company\u2019s client.<\/p><p>In contrast, a <strong>Processor<\/strong> is the entity that processes the data on behalf of the controller. Typically most SaaS companies are processors.<\/p><p>However, instead of taking the traditional role of being a Processor, we\u2019ve elected to take the role of a \u201c<strong>Joint Controller<\/strong>\u201d for a couple reasons.<\/p><p>First is in regards to roles. On one hand, the decision where to place a link is yours, and the purpose of us processing that link is for you. However, we are making the decisions about which information is being collected in order to provide the service, how that information will be stored, and the length of time for which that information will be stored (click data, sans-IP is stored indefinitely, client data is stored for seven years post account closure).<\/p><p>Second is in regards to burden. We can reduce our risk and liability by making some minor tweaks to our service, such as providing a couple options along how long data might be stored and which reports you want, and then take the role of Processor. However, we feel that puts a significant burden on you, our client. That felt like that was a cop out. We work hard to make our service easy and friendly to use. Taking the role of a \u201cJoint Controller\u201d alongside you, our client, fit much better with our values and how we like to approach business.<\/p><p>Please note that in taking this role we now have an important addition to our \u201ccontract,\u201d the Terms of Service that govern our relationship. A \u201c<strong>Data Processing Addendum<\/strong>\u201d can be found in our updated <a href=\"https:\/\/geniuslink.com\/terms\">Terms of Service<\/a> and defines the division of our roles as the Controller. These tools include HubSpot, Intercom and Drift.<\/p><ul><li>HubSpot is used to manage our monthly newsletters as well as various other educational and marketing emails about using our service or getting the most out of your links.<\/li><li>Intercom is used for our onboarding and support related messaging. When you are signing up and verifying your email address you are interfacing with us via Intercom. For those that are curious, here is a quick run down of those items.<\/p><p><a href=\"http:\/\/privacyshield.gov\/list\" target=\"_blank\" rel=\"noopener\">Privacy Shield<\/a> is the sequel to Safe Harbor and is a more strict framework for how personal data should be dealt with at a company. As the US doesn\u2019t, by default, have any legislature that covers personal data privacy to the level that is required by EU, the Privacy Shield framework was put in place by the US State Department. Having \u201cPrivacy Shield\u201d set up allows us to store personal data (from our clients based in Europe) on servers here in the US and allow our team (US based) to use that data in our work. More info about Privacy Shield can be found here.<\/p><p>In the initial process of getting set up for Safe Harbor, back in 2015, we documented a number of different processes related to data processing and security in general. In prep for Privacy Shield we did a thorough review to ensure everything was up to date and accurate. These internal documents outline processes for employee hiring and discipline, security and incident responses, policies and procedures as well as defining roles, systems and the life cycles for data and privacy. All very important but quite monotonous!<\/p><p>We also updated our Terms of Service, as we periodically do. We put together a separate blog running through the minor updates we made but the biggest piece was the inclusion of a Data Processing Addendum.<\/p><p>The Data Processing Addendum defines who (you or us or both of us) is responsible for things like dealing with access requests, record keeping, breach notification, audits, etc. All the fun stuff you\u2019d expect is necessary to have a clear understanding of the relationship. The best part is that it\u2019s only about two pages so I\u2019d definitely encourage you to read through it.<\/p><p>For our Privacy Shield application we also need to update our Privacy Policy to include some important pieces necessary for both the Privacy Shield as well as GDPR. We\u2019ve included an overview of the changes we\u2019ve made to our Privacy Policy in the second section of the blog post describing our updated Terms of Service.<\/p><p>Along with our work for compliance with GDPR we are also taking a long overdue step to come into compliance with ePrivacy, the European based legislation that is responsible for all of those pop ups on EU based websites letting you know that a site uses cookies. An updated ePrivacy legislation is expected to be coming not too far behind the GDPR deadline. GDPR includes a more granular approach to getting consent where site visitors can pick and chose which, if any, cookies or pixels they are allowing. Further, when granted permission to pixel a visitor there is mandate to actually log the relevant information in order to prove you got consent and to aid in the Data Subject Rights.<\/p><p>The GDPR framework also suggests the addition of a new role to a business, especially those that have businesses where personal data is a key component. That role is a \u201cData Protection Officer\u201d and they are intended to be an independent entity inside the business with the sole focus of ensuring good compliance to rules and regulations around privacy. Due to our size, business focus and location, we\u2019ve elected not to employee a \u201cDPO\u201d. Rather we\u2019ve collectively decided to make me, Jesse Lakes, the CEO and Co-Founder of Geniuslink, the point of contact for all data privacy and GDPR related issues. Further, we\u2019ve elected our other co-founder and CTO, Jesse Pasichnyk as our Security office to ensure top down \u201cdata protection by design\u201d. We felt it was best that the two people that have the most to lose by getting this wrong were the ones who spent the time and resources to double check everything and be held accountable.<\/p><p>Finally, while not part of GDPR, ePrivacy, or even Privacy Shield related, but in the spirit of dotting all of our \u201ci\u201ds and crossing all of our \u201ct\u201d\u2019s, we\u2019ve also rolled out an Affiliate Disclaimer and a Spam Policy.
